Welcome to littlenook.ca, operated by Little Nook (“Little Nook,” “we,” “us,” or “our”). These Terms of Service govern your access to and use of the Site, our products, and our services. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility & Account

You must be the age of majority in your province or territory of residence, or have the consent of a parent or legal guardian, to make purchases on the Site.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

2.Changes to the Terms or the Site

We may update these Terms or any part of the Site at any time. If changes are material, we will update the “Last updated” date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

3. Products, Availability, and Accuracy

We strive to present product descriptions, specifications, colors, pricing, and availability as accurately as possible. However, we do not guarantee that all product information is complete, current, or error-free.

We reserve the right to:

• limit quantities or reject orders where appropriate.
• correct errors or inaccuracies,
• update product information,
• change or discontinue products at any time, and

4. Orders & Acceptance

Your order is an offer to purchase the items in your cart. We may accept or reject any order in our discretion, including for reasons such as:

• product unavailability,
• suspected fraud,
• pricing or listing errors, or
• payment issues.

An order confirmation email means we have received your order. Acceptance of your order occurs only when the item is shipped.

5. Pricing, Currency, Taxes & Duties

Unless otherwise stated, all prices on the Site are listed in Canadian Dollars (CAD).

Applicable sales taxes will be calculated at checkout based on the shipping destination. For orders shipped outside Canada, customers may also be responsible for customs duties, import taxes, brokerage fees, or other destination-country charges, unless otherwise stated.

If additional mandatory charges apply to a specific destination or order type, those charges will be presented during checkout before you complete your purchase. The Competition Bureau treats hidden mandatory fees as a compliance risk, so mandatory charges should be disclosed upfront.(competitionbureau.gc.ca)

6. Payment

We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us to charge the full order amount, including applicable taxes and any disclosed shipping or destination-related charges.

7. Shipping, Delivery, and Risk of Loss

• We currently ship to Canada and the United States.
• Typical processing time is 2 business days after payment confirmation.
• Estimated delivery times after dispatch are:
• Canada: 3–7 business days
• United States: 4–10 business days
• Orders over CAD $99 may qualify for free shipping where stated at checkout. Orders under CAD $99 may be subject to a flat shipping fee of CAD $9.90, unless otherwise specified.
• Delivery estimates are not guaranteed. Once we hand an order to the carrier, risk of loss and title pass to the customer to the extent permitted by applicable law. Refused or undeliverable shipments may be returned at the customer’s expense.

8. Returns, Exchanges & Refunds

Unless otherwise stated on the product page, we only accept returns or exchanges for items that are:

• defective,
• damaged in transit, or
• incorrect items shipped in error.

Return or exchange requests must be made within 14 days of delivery.

To be eligible, returned items must be unused, in original condition, and returned with original packaging, tags, and accessories where applicable.

Refunds, when approved, are issued to the original payment method after the returned item has been received and inspected.

This policy does not limit any rights you may have under applicable consumer protection laws. Ontario notes that there is no general automatic right to return goods unless required by law or by the seller’s own policy.(ontario.ca)

9. Defects, Shortages & Damages

Please inspect your order upon delivery and contact us as soon as possible if an item is defective, damaged, or incorrect. To help us assess the issue, please provide clear photos of:

• the item,
• the packaging, and
• the shipping label, if relevant.

10. Safety, Use & Local Regulations

Fishing tackle may contain sharp hooks, pointed components, or small parts. Keep products out of reach of children and handle them responsibly.

You are responsible for complying with all applicable fishing laws and local regulations, including rules relating to seasons, licensing, species restrictions, slot limits, and gear requirements. Little Nook is not liable for misuse of products.

11. Promotions, Bundles & Gift Cards

Promotions, discount codes, and bundle offers are subject to the terms stated at the time of the offer and may not be combined unless expressly permitted.

If gift cards are offered, they are not redeemable for cash except where required by law and may not be replaced if lost or stolen.

12. User Content & Reviews

If you submit reviews, photos, videos, or other content (“User Content”), you grant Little Nook a non-exclusive, royalty-free, worldwide license to use, reproduce, display, adapt, and publish that content in connection with our business, Site, and marketing.

You represent that:

• you own or control the rights to the User Content,
• your content does not violate any law, and
• your content does not infringe the rights of any third party.

13. Acceptable Use

You agree not to:

• violate any applicable law,
• engage in fraud or unauthorized access,
• interfere with the security or operation of the Site,
• use automated tools to scrape, copy, or monitor the Site without permission, or
• exploit Site content except as expressly permitted.

14. Intellectual Property

All content on the Site, including text, graphics, logos, photos, product descriptions, and code, is owned by or licensed to Little Nook and is protected by applicable intellectual property laws.

You may not use our trademarks, branding, or copyrighted materials without prior written permission.

15. Third-Party Links & Services

The Site may contain links to third-party websites or services. We are not responsible for their content, availability, or policies. Your use of third-party services is at your own risk.

16. Disclaimer of Warranties

Except as expressly provided by applicable law or any manufacturer’s written warranty, the Site and all products and services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain warranty limitations, so some of the above may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by law, Little Nook and its directors, officers, employees, affiliates, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of the Site or any product purchased through the Site.

To the maximum extent permitted by law, our total liability for any claim relating to a product or order will not exceed the amount paid by you for the specific product or order giving rise to the claim.

Some jurisdictions do not permit certain exclusions or limitations, so parts of this section may not apply to you.

18. Indemnification

You agree to indemnify and hold harmless Little Nook and its affiliates, officers, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from:

• your breach of these Terms,
• your misuse of the Site, or
• your violation of any law or third-party right.

19. Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.

You agree that any dispute arising out of or relating to these Terms or the Site will be brought before the courts located in Toronto, Ontario, unless applicable consumer protection law requires otherwise.

20. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

Any provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnities, and governing law provisions.

21. Electronic Communications

By using the Site or contacting us electronically, you consent to receive communications from us electronically, including by email and notices posted on the Site. You agree that such communications satisfy any legal requirement that communications be in writing.
